How can I prepare for a child custody dispute?

Facing a child custody fight can be challenging, but by preparing thoroughly, you will improve your chances of a favorable outcome. However, there are ways that parents can get ready for a child custody case in Texas.

Familiarize yourself with our state’s child custody standards

The state of Texas bases custody decisions on what is in the child’s best interests. Judges typically prefer arrangements that allow both parents to be actively involved. Courts may lean toward joint custody unless one parent’s ability to care for the child is seriously questioned.

Keep a parenting journal

A powerful piece of evidence that you can begin to craft now is a parenting journal, which is created by documenting daily interactions with your child. Notate all your involvement with your child, including helping with homework, cooking meals, attending activities, etc. If you and your child are interacting, or you are doing something for your child, it should be in the parenting journal. These journals show the court your consistent role a parent plays in their child’s life.

Gather evidence of your involvement

Next, gather evidence that substantiates your journal. Gathering any documents that reflect your positive engagement in your child’s life. This includes school, medical and financial records. Some of this will be reflected in your parenting journal, but some of this will be documentation from prior to the journal.

The records from the school should show attendance at parent-teacher conferences, sporting events and other school events. The medical records should show how you have been involved in your child’s healthcare needs, like your attendance at various healthcare appointments. Finally, your financial documents need to demonstrate that you have the financial ability to support and care for your child.

Find reliable witnesses

Another way to reinforce your case is through witnesses who can attest to your parenting skills. These are people that have seen both you and your child together, like teachers, coaches and family friends. Each of these people can provide the court with insights into your relationship with your child.

Maintain a positive attitude

In custody disputes, your behavior is closely watched by the courts. Try to remain calm, respectful and cooperative throughout the process. Avoid negative comments or actions that could be seen as hostile toward the other parent. Courts favor parents who demonstrate a cooperative attitude for the child’s well-being.

By taking these steps, parents can present a compelling case for custody and demonstrate their dedication to their child’s best interests. Preparation is key, and with the right mindset, evidence and organization, they can navigate this process effectively.
